LIABILITY WAIVER AND RELEASE AGREEMENT
IN CONSIDERATION OF my being permitted to participate in activities of Duffy’s, GMAPA Inc., Duffy’s Adventures, Slate Creek Mining Camp, use of Bush Plane(s), use of ATV’s and Trail activities and for $10.00 and other consideration I agree to the following Waiver and Release.
I accept that prospecting, recreational mining, flying and all terrain vehicles or other forms of recreation and transportation, as well as activities in remote areas of Alaska has inherent risks, hazards and dangers for everyone involved and that these cannot be eliminated. These risks, hazards and dangers include without limitation:
a. Water injury including drowning; b. Walking in rugged areas; c. Bears and other wildlife; d. Risks because of weather conditions; e. Use of equipment and machinery; f. All terrain vehicles; g. Aircraft; h. Firearms; i. Physical exertion or emotional conditions; j. Remoteness creating a lack of emergency and medical personnel; k. Burns from fires; l. Hot foods or liquids; and, m. Unknown and unforeseen situations or conditions.
I understand the risks, hazards and dangers above and understand that there may be unknown and unforeseen situations or conditions during transport and while involved in any recreational activity. I am aware that physical condition and a degree of skill and knowledge may be required on my behalf and I believe that I possess the skill and knowledge required and am in good physical condition.
I understand that I am responsible for myself and that my participation is strictly voluntary and that no one is forcing me to participate and I hereby elect to participate in spite of the risks, hazards and dangers. I am voluntarily prospecting and recreational mining at Slate Creek Mining Camp, Duffy’s Roadhouse, Duffy’s Adventures and accept and assume any and all risks or injury or death.
I for myself, my heirs, successors and executors, hereby knowing, willingly and intentionally waive and release and indemnify and hold harmless Duffy’s, GMAPA Inc., Duffy’s Adventures, Slate Creek Mining Camp, bush pilots and ground transport operators, their owners, directors, officers, agents, employees and volunteers from and against any and all claims, actions, causes of actions, suits, expenses including reasonable attorneys’ fees which are related to, or connected with my participation in any activity offered, including, but not limited to Negligence of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of my damage or loss, injury, paralysis, or death to me or any underage children under my directions and supervision, or my property as a result of my participation in these activities or use of services, equipment or property whether such damage, loss, injury, paralysis or death results from negligence of SCMC or from some other cause. I for myself, my heirs, successors and executors further agree not to sue SCMC, Duffy’s Roadhouse, Duffy’s Adventures, their employees or volunteers or subcontractors as a result of any injury, damage, paralysis or death suffered in connection with my use and participation in the activities or prospecting and recreational gold mining.
This Waiver and Release is intended to be as broad and inclusive as permitted by Law. If any part of this Waiver and Release should be held to be invalid the remainder of this Waiver and Release shall remain valid and fully enforceable. I further agree that the venue for any legal proceeding shall be in Anchorage Alaska.
I have carefully read, understand, agree to and voluntarily sign this Waiver and Release Agreement.
